Window Select confirms Chapter 11 bankruptcy, seeks to fulfill outstanding contracts
MENOMONEE FALLS, Wis. (CBS 58) -- Window Select, a window and door company based in Menomonee Falls, has entered into Chapter 11 bankruptcy to fulfill contracts and past due commitments to over 850 customers.
According to a press release issued by Window Select on Friday, Feb. 17, a team of third-party advisors from Cogent Analytics attempted to contact all customers with outstanding contracts to provide an update and discuss options. They claim the team has spoken with 1,100 customers, 850 of whom have confirmed their desire to move forward with installation.
Through the legal process navigated by the new leadership team, the remaining outstanding customer contracts are estimated to be fulfilled before the end of the year.
Interim CEO of Window Select, Andy Parsons, stated that the company's vision is to do right by the customers of Wisconsin. He also explained that the company is working to change the lack of transparency and communication experienced by customers in the past, claiming the new leadership team has fulfilled 25 customer contracts since its transition in Dec. 2022, completing up to four installations each week.
Parsons added, "We continue to stand up for customers to ensure the greatest number of resources possible go to fulfilling outstanding contracts because we believe doing the right thing is what makes future success possible.”
The company claims that the goal of entering Chapter 11 bankruptcy is transfer customer orders to a new entity for fulfillment, unlike Chapter 7, which would void contracts and "leave customers with nothing." The legal reorganization process is expected to take eight to 12 weeks, with a filing window required by the court system.
Customers with outstanding contracts who have already been in contact with the customer service team is being told to expect an email detailing options to fulfill their contract by Mar. 31.
Window Select's new leadership team says they are committed to ensuring customers are the first priority throughout the reorganization process, with the goal of doing right by its customers and finding solutions for them.
Rob Braiman, President of Cogent Analytics told CBS 58 that they are working to ensure customers are taken care of, but that those asking for refunds may not be satisfied. "What we're hoping in bankruptcy protection is that any dollars that can be shifted back to the customer is shifted back, but I can assure you there's really nothing left in Window Select other than we and a group of investors that are trying to do that right thing."
