12-year-old released from custody after fatal shooting near 51st and Hadley
UPDATE on Thursday, Dec. 19 at 4:02 p.m.:
According to the Milwaukee County District Attorney's Office, the 12-year-old boy was released on Wednesday, Dec. 18 and will not face any charges.
The DA says they came to the decision as they found the boy was acting in defense of his mother who was a victim of domestic violence.
CBS 58 spoke to a neighbor about the incident earlier this week. She said he was doing what he could to keep his mother safe.
"He was protecting his mom to me," said Tracy Jackson, neighbor. "Hate that someone had to lose their life, but someone harming his mom he probably didn't know what to do but help his mom and that's what he did."
The man who died was 32-year-old Levon Osuji. Court records show Osuji had previous charges of repeated domestic abuse and stalking. Police reported different incidents saying he choked, hit, and pointed a gun at a woman, and also hit a woman with a hammer repeatedly.
