Eye drop murder trial: Jury learns more about victim's estate
WAUKESHA, Wis. (CBS 58) — The eye drop murder trial in Waukesha resumed for the sixth day on Tuesday, Oct. 31.
Jessy Kurczewski of Franklin is facing one charge of first-degree intentional homicide and two counts of felony theft.
Prosecutors allege Kurczewski, 39, fatally poisoned her friend who she was caring for with eye drops and then staged the scene to look like an overdose.
They then claim Kurczewski stole $290,000 dollars from the 61-year-old victim Lynn Hernan.
On Monday, testimonies focused on the defendant’s spending habits.
Tuesday, however, looked at Hernan’s will and estate and who the money would go to.
Kurczewski is one of the only two people named.
The other is Anthony Pozza, who is the son of one of Hernan’s closest friends.
Pozza took the stand on Oct. 31, testifying that Hernan was careful with her money and mostly used cash and checks.
When asked if Pozza had anything to gain financially out of this he responded with, “absolutely not.”
He was then asked would he be interested in the money if he did stand to gain anything?” Pozza replied, “no.”
And finally, when asked what his concern in the trial was, Pozza replied, “justice for Lynn.”
Kurczewski, who has pleaded not guilty, could face life in prison if convicted.
The trial is expected to last for five weeks.
