Federal judge denies motion to dismiss charges against Judge Hannah Dugan

MILWAUKEE (CBS 58) -- A federal judge on Tuesday, Aug. 26, denied a motion to dismiss charges against Milwaukee County Circuit Judge Hannah Dugan.

Dugan is charged with concealing a person from arrest and obstructing federal immigration proceedings. Prosecutors allege she intervened in an Immigration and Customs Enforcement attempt to arrest an individual outside a Milwaukee County courtroom in April.

U.S. District Judge Lynn Adelman ruled that Dugan is not entitled to judicial immunity in a criminal case and rejected arguments that the prosecution violated the Tenth Amendment. The indictment accuses Dugan of confronting ICE agents, directing them to leave the courthouse hallway and allowing the subject of the warrant to exit through a nonpublic door.

The case will return to court on Wednesday, Sept. 3 for a scheduling hearing. The full motion can be read below:
