Complaint: Driver intoxicated during deadly Franklin crash

FRANKLIN, Wis. (CBS 58) -- A man is charged after a crash in Franklin that killed a 74-year-old. 

Fifty-eight-year-old Leonel Molina Rios was charged with knowingly operating a motor vehicle without a valid license and homicide by intoxicated use of a vehicle. 

Police were called to the area of Lovers Lane and Rawson on Saturday, Nov. 2 for the crash. 

According to the criminal complaint, upon arrival, police saw that the two vehicles, a Ford Expedition and a Honda CRV, had been involved in a crash and each vehicle had severe front-end damage. 

Police say they saw the Ford Expedition in the southbound lanes of Lovers Lane Road, and there was one person in the driver's seat. The person was identified as Molina Rios. According to the complaint, the Honda CRV crashed into the guardrail on the northbound lane. Police say an elderly man lying in the middle of the northbound lane. 

The crash was in a construction zone. 

According to the complaint, police saw a man, who said he was a firefighter, administering chest compressions on the elderly man. The fire department arrived on scene to treat the elderly man but was pronounced dead. 

Police say Molina Rios was conscious and bleeding from the left arm. Molina Rios was provided medical care and transported to a hospital.

Per complaint, police checked the status of Molina Rios' driver's license and found that he did not have one. 

Molina Rios told police that he used to have a driver's license, but knew that he was driving without a valid license, and he only has a Wisconsin ID.

Preliminary investigation shows that Molina Rios' Ford Expedition was going northbound when it crossed the center line, causing the head on collision with the Honda CRV, according to the complaint. 

Molina Rios, per complaint, told police that he works at a hotel in Oak Creek. He said he stopped at a bar after work and began to drink alcohol. He said he believed that he was impaired when he drove away from the bar, per complaint. 

He said he could not recall which vehicle collided with which, just that an accident happened. 

Police made contact with a bartender at the bar, who said she served him "“4-5, 5-6 beers and two shots that were Jack." She said the shots were in smaller glasses, per complaint. 

Molina Rios' bond was set to $150,000.
