MILWAUKEE (CBS 58) -- Thursday, Jan. 5, Kevin McCaa, a man charged in the killing of Milwaukee postal worker Aundre Cross, was supposed to be in court for his preliminary hearing. 

McCaa was charged in a separate case where he allegedly fired a gun at a family member back in June.

Although McCaa's court date was set for Thursday, the court did not know he was being held in federal custody, so he did not make an appearance.

His preliminary hearing was rescheduled for Feb. 2.

Now members of the National Letter Carriers Association (NLCA) are calling into question language brought forth in the criminal complaint about Cross' death.

A lengthy 28-page criminal complaint details the moments leading up to the murder of Cross.

Part of those documents allege Kevin McCaa and Charles Ducksworth Jr. received suspicious packages consistent with drug trafficking.

Investigators say 44-year-old Aundre Cross scanned a package in December as "delivery attempted -- no access to delivery location."

The criminal complaint said that scan combined with evidence the package was not returned to a USPS facility, could indicate Cross kept the package or gave it to someone else outside of normal operations.

That allegation is being called into question by the Milwaukee chapter of the NLCA.

"I am not a lawyer, so I won't speak to how the wording was. I've read documents like this in the past and its legalese, and I don't think it was properly put forward," said Dave Skowronek, Milwaukee President of National Association of Letter Carriers, Branch II. "[Cross] was a well-respected, well liked, his coworkers had nothing but good things to say about him."

Ducksworth is scheduled to appear in federal court Jan. 10 and McCaa on Jan. 11.
