MILWAUKEE (CBS 58) -- Witnesses say a man with a walker was walking on West State Street towards 29th Street along a row of parked cars in the street when he was hit.

“I just heard some booms and commotion outside, I looked outside and really didn’t see anything, and I looked back out it was taped off everywhere,” said Gwen Simpson, a witness.

The 64-year-old victim died at the hospital following the crash Monday night. 

“It’s sad because he’s the jolly man in the neighborhood he talks to everybody,” Simpson said.

Right now police aren’t releasing the name of the victim until they notify his family.

“He walks around here all the time,” Simpson said. “When I saw that wheel-walker I knew exactly who it was.”

The victim was a resident at the Crossroads Care Center nursing home which is just about a half mile from the crash site. On the phone, the nursing home said the man was authorized to leave the nursing home and that they are now grieving.

Milwaukee police say the driver stayed on the scene, but was arrested and cited for refusing to take an intoxication test. We are not naming him because he hasn’t been charged yet.

A police warrant says the man admitted to drinking and police found an open bottle of brandy in the car. The warrant says he was staggering and slurring his words. Police say his 8-day-old baby and the child’s mother were in the car at the time of the crash. The warrant says the driver has been convicted of three OWI’s dating back to 2007. The District Attorney’s office will be reviewing the current case in the coming days.

UPDATE: MILWAUKEE (CBS 58) -- Milwaukee Police are now saying the driver of a car that hit and killed a 64-year-old man Monday night was cited for refusing to take an intoxication test.

Police also confirmed there was an 8-day-old baby in the car at the time of the crash. 

The identity of the victim has not been released.

MILWAUKEE (CBS 58) – Milwaukee Police say one person is dead after a crash near W. State St. and N. 27th St. Monday evening.

Around 8:55 p.m., a 64-year-old man was hit by a car and despite lifesaving measures; he passed away from his injuries, according to police.

The driver of the car remained on the scene and was arrested.

An investigation into the incident is ongoing.
