State Supreme Court to hear case challenging ICE detainers in county jails

MILWAUKEE (CBS 58) -- Justices on the Wisconsin Supreme Court have voted to hear a case arguing it's illegal for jails to hold immigrants under federal orders. 

The case was brought to the court by the ACLU, representing Voces de la Frontera.  They're suing sheriffs in five counties: Walworth, Kenosha, Brown, Sauk, and Marathon. 

Immigrants are held in those county jails on detainers sent by Immigrations and Customs Enforcement (ICE). The lawsuit argues it's illegal. 

Sheriffs have argued that since the law is so complicated, this case should have gone through lower courts first. 

The lawsuit comes as cities like Chicago and Charlotte have had an influx of ICE agents and immigration arrests.  

"This is something that is timely; we are grateful that the court has recognized that this is an urgent and time sensitive matter and this is gonna move forward," said Christine Neumann-Ortiz, executive director of Voces de la Frontera. 

Written arguments are due to the court in less than two months. Then, the court will need to schedule oral arguments. 

A decision in the case could come down sometime in the middle of next year.
