Milwaukee County Jail MILWAUKEE (CBS 58) — An 18-year-old Milwaukee woman has been formally charged in connection with a road-rage shooting that killed a 44-year-old woman Monday, Aug. 17.
Mariah Ruiz is charged with first-degree reckless homicide with use of a dangerous weapon. If convicted, she could face up to 65 years in prison.
According to a criminal complaint, Milwaukee police were called to the intersection of South 10th Street and West Lapham Boulevard shortly after 2:30 p.m. for a report of a person who had been shot.
Officers found Minerva Hernandez-Lopez lying in the street outside the driver's side of her vehicle. First responders attempted lifesaving measures, but she died at the scene.
An autopsy determined Hernandez-Lopez died from a gunshot wound to her left shoulder. The bullet entered her shoulder and exited near the base of her neck, according to the complaint. Her death was ruled a homicide.
Investigators found four bullet strikes to the rear tailgate of Hernandez-Lopez's vehicle, along with a shattered rear window and blood stains on the steering wheel. Detectives also recovered five fired .40-caliber cartridge casings and two bullet fragments on West Lapham Boulevard between South Ninth and South 10th streets.
Security footage reviewed by Milwaukee police showed Hernandez-Lopez's vehicle traveling east on West Lapham Boulevard before coming to a stop. A vehicle allegedly driven by Ruiz was following closely behind and stopped behind Hernandez-Lopez.
The complaint says Hernandez-Lopez slowly backed up and bumped the front bumper of Ruiz's vehicle. Ruiz was then allegedly seen reaching out of the driver's-side window and pointing an object toward Hernandez-Lopez.
Three gunshots could be heard in the video, investigators said.
Hernandez-Lopez then began driving away as two more gunshots could be heard. Investigators said Ruiz appeared to follow Hernandez-Lopez before both vehicles disappeared from the camera's view. Four additional gunshots could then be heard.
Ruiz later turned herself in to Milwaukee police with several family members and friends, including her mother and a 16-year-old friend.
Ruiz's mother told officers her daughter had shot and killed someone and said the firearm used in the shooting was inside her vehicle, according to the complaint. Officers searched the vehicle with consent and recovered a firearm.
Detectives also interviewed Ruiz's 16-year-old friend, who was sitting in the front passenger seat during the shooting.
The teen told investigators Ruiz was driving to El Rey Supermarket when she cut off Hernandez-Lopez's vehicle. Hernandez-Lopez later pulled alongside Ruiz and reportedly told her, "Little girl, you need to drive."
According to the complaint, Ruiz responded by threatening to call Immigration and Customs Enforcement on Hernandez-Lopez while allegedly pulling out a firearm.
The teen said Hernandez-Lopez continued following Ruiz, eventually pulling alongside her and recording the encounter on her cellphone. Hernandez-Lopez reportedly said she was recording because Ruiz should not have a gun.
The 16-year-old told investigators he pulled Ruiz's hand down because he believed she was going to shoot Hernandez-Lopez.
The road-rage encounter continued, according to the complaint, including Hernandez-Lopez allegedly brake-checking Ruiz.
The teen told investigators Ruiz then pointed the firearm toward Hernandez-Lopez and began shooting. Hernandez-Lopez drove away, but Ruiz allegedly continued following her and fired again as Hernandez-Lopez made a U-turn.
The 16-year-old said he saw Hernandez-Lopez's head slump and immediately believed she had been shot and killed.
During an interview with investigators, Ruiz acknowledged shooting Hernandez-Lopez and later wrote an apology letter to her family, according to the complaint.
Ruiz told investigators the confrontation began with a honking incident and said Hernandez-Lopez yelled at her in Spanish. She acknowledged threatening to call ICE on Hernandez-Lopez before Hernandez-Lopez drove around her and made an obscene gesture, prompting Ruiz to follow her.
Ruiz said Hernandez-Lopez later stopped on Lapham Boulevard and blocked her vehicle before backing into it. Ruiz told investigators that was when she pulled out her gun and began shooting. She also said the 16-year-old passenger had told her not to shoot.
According to the complaint, Ruiz said she was having a bad day and had been fighting with her mother. She told investigators she did not mean to hurt Hernandez-Lopez and was not sure why she fired the gun.
Ruiz is expected to make her initial court appearance Friday, Aug. 21.
