MILWAUKEE (CBS 58) -- The family of the man shot and killed by police this week has retained a civil rights attorney. 

B'Ivory Lamarr will represent the family of 23-year-old Printis Smith.

Officials say Smith died after a shootout with officers after he fled from police. 

He was reportedly in a car wanted for a shots fired case in Glendale. 

Smith apparently had a gun in his hand, another in his waistband, and a third gun was found in the car. 

An officer was injured and is recovering at home. 

The family says that Smith had his back to the officer at the time of the shooting and he was never given a clear command to drop his weapon. 

They want to know if deadly force was warranted. 

"These issues I believe warrant some scrutiny and further answers from the police department," said Lamarr. “What was the nature of the injury alleged by the officer? Are we talking about a sprain that developed from a chase in chasing after Printis or are we talking about a gunshot?”
