ICE detains 8-year-old boy and mom at Wisconsin Dells home, community calls for their release

WISCONSIN DELLS, Wis. (CBS 58) -- An 8-year-old boy and his mother were reportedly detained by immigration agents at their Wisconsin Dells home early Tuesday morning.

CBS 58 has learned 43-year-old Diana Socha Torres and her son are no longer in the state. Now, community members are calling for the release of the asylum seekers. 

Diana's partner of 20 years tells us they moved to Wisconsin Dells about three years ago, fleeing "terror and violence," and they applied for asylum a few months after getting here.

The partner says there was a deportation order for Socha Torres because she missed a court hearing. But she says she never got a notice. An attorney last month reportedly filed an appeal, but ICE told them there's no record of an appeal in their system, thus filing a deportation order.

ICE reportedly told the family that officials were going to change Diana's ankle monitoring system on Tuesday, June 23. Instead, the mom and son were told they had to go with ICE and were detained. They were later taken to the processing center in downtown Milwaukee.

"A mom and a small child should not be incarcerated... any kind of challenge to her deportation can happen outside of a jail. She has no criminal record. On the contrary, she's someone who's fleeing violence, seeking asylum, that is her legal right," said Christine Neumann-Ortiz, executive director for Voces de la Frontera.

Socha Torres is now working with an immigration attorney who tells us the mother and son have already been moved from Milwaukee and are on their way to a detention center in Texas.

Diana's partner, over the phone Tuesday between tears, said he felt "desperate" and wants his family back.
