MILWAUKEE (CBS 58) -- Prosecutors have charged 30-year-old Gavino Avalos-Morales in connection to a fatal shooting at MPS South Stadium during a youth flag football game: Arrest made in deadly shooting at flag football game.

Avalos-Morales has been charged with first degree reckless homicide, discharge of a firearm in a school zone, and possession of a firearm on grounds of a school. 

According to the criminal complaint, on Oct. 12th, Milwaukee Police were dispatched to a shooting at 1023 West Windlake Ave. at around 1:00 p.m. Which is the location of Hayes Bilingual School and the Milwaukee Public Schools South Stadium. 

Upon arrival, officers located the victim, who has been identified as 47-year-old Raysean Barnes. The Milwaukee Medical Examiner's Office determined Barnes suffered a single shot to the abdomen. 

The complaint goes on to say Avalos-Morales had been seen on security camera footage parking a white Mazda CX-9 in front of the Stadium and exiting with two other men, before entering through the gate and into the bleachers.

Three minutes later Avalos-Morales and a man he came with were seen walking from the bleacher area, with the victim seen walking approximately ten to twelve feet behind them.

The video also shows two other men leaving from the bleacher area.

As everyone is walking down the ramp towards the concession area, one of the following men starts running towards Avalos-Morales and his companion. 

The man jogs past the victim and runs straight at the man with Avalos-Morales, jumping in the air and punching him, starting a fight. 

As this is happening, Avalos-Morales can be seen on the video withdrawing a firearm from his clothes, appears to ready the firearm and then turns in the direction of the victim, who appears to be moving past Avalos-Morales and the two fighting men.

According to the complaint, the video then shows Avalos-Morales point the firearm at the victim, who at that moment appears to have both of his hands raised, palms forward in what appears to be a surrender position.

The victim then falls suddenly, face first to the ground, consistent with having been shot.

Avalos-Morales and the man who he was with then fled the stadium and the school grounds. 

The complaint states the victim is not seen with a weapon at any time during the video.

Police conducted a scene investigation and found two fired 9mm cartridge castings in the area where the victim was located. 

After analysis, it was determined that the casings were consistent with having been fired by the same firearm that fired five 9mm cartridge casings in the alley behind 1524 S. 10th Street back in May 2024.

Video from that incident reveals a white SUV, consistent with the same Mazda CX-9 Avalos-Morale drove on the day of the deadly shooting at MPS South Stadium, pull up in the alley. Muzzle flashes can then been seen coming from the driver’s window of the vehicle.

Avalos-Morales in due in Milwaukee County Court on Oct. 31st for a Preliminary Hearing.
