MILWAUKEE (CBS 58) – A Whitefish Bay man is charged in connection to a fatal road rage shooting in Milwaukee on Friday.

Matthew Wilks, 35, is facing charges of first degree intentional homicide and possession of a firearm by a felon.

Court documents say police responded to a shooting around 5:26 p.m. near 51st and Capitol.

MPD also received a call from the hospital in regard to the same shooting incident.

A man who said the victim, Tracey Smith, was his mother, drove her to the hospital. Smith was pronounced dead at 5:38 p.m.

Smith’s son told officers they were driving when a van cut in front of them, causing their car to hit the driver’s side of the van.

As soon as he stopped his car, Smith got out to look at the damage. Then, he says a man opened the driver’s side door of the van and his mom got upset and started yelling at the driver. According to the criminal complaint, he said "expletive, I'll kill you." 

The driver then pointed a gun at Smith and shot her. Smith’s son heard his mom say “he shot me” before she stumbled and fell. The van drove off and Smith’s son then drove her to the hospital.

Officers were able to find surveillance video of incident and identified the van involved in the crash through a license plate. They learned the car belonged to Wilks.

Smith’s son identified Wilks through a photo. He faces life in prison.

On Wednesday, his bail was set at $100,000. His preliminary hearing is on September 12.
