DOJ investigating officer-involved shooting death in Fond du Lac County, weapon recovered
Update on Friday, March 7 at 7:30 p.m.:
According to the Wisconsin Department of Justice, last Monday, Jesus Mendez-Berry called 911, saying he wanted to turn himself in for an active warrant.
Shortly after that, Mendez-Berry was spotted walking around and flashing a gun. He was later shot and killed by Fond du Lac County deputies after he reached for what looked like a gun.
According to the DOJ, it was actually a pellet gun, designed to look like a real weapon.
The deputy who fired that remains on administrative leave.
FOND DU LAC, Wis. (CBS 58) -- The Wisconsin Department of Justice is investigating an officer-involved shooting death in the Town of Fond du Lac on Mon. Feb. 24.
The DOJ says the Fond du Lac County Sheriff's contacted a suspect with a felony warrant via phone, before locating them near Cherrywood and Lakeshore after a citizen told them the same subject had appeared to have a handgun in their waistband.
Officials say the suspect refused to follow repeated commands and one of the deputies discharged a non-lethal weapon.
Shortly after, the suspect brought out what deputies believed to be a firearm. That is when a second deputy fired their weapon, striking the subject at 6:22 p.m.
The suspect was taken to a hospital, where they died.
No law enforcement officials or citizens were injured during the incident.
The deputy who fired their weapon is on administrative assignment, per agency policy.
The DOJ says additional details are being withheld and will be released to the public at a later time.
