BURLINGTON, Wis. (CBS 58) -- An arrest warrant has been issued to find Justin Michael Kiswardy, the former owner of Window Select. 

Kiswardy is accused of defrauding two customers in February of 2022 in the Town of Day, located in Marathon County. It's the first criminal charge filed against Kiswardy. 

Kiswardy was supposed to be in court in Marathon County on Thursday, May 4, but did not show up. The court then authorized a warrant for his arrest. 

CBS 58's Tajma Hall has spent more than a year documenting local complaints against the Menomonee Falls-based company. Hundreds of customers say they're still waiting for a refund or for the work that they paid for to be done.

If Kiswardy is convicted on the charge of theft by false representation, he could face a fine of up to $10,000, imprisonment for up to six years, or both.

Customers say they want to see Kiswardy held accountable. 

"These customers deserve answers," said Lisa Schiller, Director of Investigations for the Wisconsin Better Business Bureau.

CBS 58 first checked in with the BBB about Window Select in March of 2022. The company still has an "F" rating on the BBB website.

"We continue to receive complaints on a regular basis. We're up to about 430 complaints to date. The complaints are going unanswered," said Schiller.

The BBB and officials with the Wisconsin Dept. of Agriculture and Consumer Protection (DATCP) say customers with unresolved issues should continue to come forward. DATCP officials say they have continued to receive complaints regarding Window Select.

CBS 58 has also been in contact with law enforcement agencies in other counties where there are ongoing investigations still open.

Window Select, now under new ownership, has since filed for Chapter 11 bankruptcy protection.
