Former Window Select owner facing felony theft charge
BURLINGTON, Wis. (CBS 58) -- A Wisconsin man is facing a felony theft charge for allegedly obtaining property worth more than $5,000 through false representation, according to a criminal complaint.
Justin Michael Kiswardy of Burlington -- former owner of Window Select -- is accused of defrauding two customers in February of 2022 in the Town of Day, located in Marathon County.
CBS 58's Tajma Hall has spent more than a year documenting local complaints against the Menomonee Falls-based company. Hundreds of customers say they're still waiting for a refund or for the work that they paid for to be done.
This is the first criminal charge filed against Kiswardy.
According to the criminal complaint filed in Marathon County, Kiswardy is charged with theft by false representation, a Class H felony. If convicted, he could face a fine of up to $10,000, imprisonment for up to six years, or both.
The charges were brought after law enforcement officers in Marathon County reviewed police reports from the Marathon County Sheriff's Department. Based on these reports, the complainant found probable cause to charge Kiswardy.
The criminal complaint is reportedly supported by statements from the defendant as well as statements from outside witnesses.
The Marathon County criminal complaint notes that Kiswardy is listed as a defendant with Windows Select in open cases for civil cases and judgments for similar behavior.
Kiswardy is scheduled for his first court appearance on May 4.
Window Select, now under new ownership, filed for Chapter 11 bankruptcy protection two months ago.
