DA deems use of force justified in deadly police shooting near 27th and Wisconsin
Surveillance video MILWAUKEE COUNTY, Wis. (CBS 58) -- The Milwaukee police officers involved in a fatal shooting back in February have been cleared, according to the Milwaukee County District Attorney's Office.
Surveillance video from the area shows 24-year-old Isaiah Stott walking down Wisconsin Avenue with a rifle prior to the incident, firing shots into the air.
Police say when officers responded to 27th and Wisconsin, they ordered Stott to drop the weapon, but he refused, opening fire and injuring MPD Officer Daniel Gonzales, who then returned fire along with Officer Joseph Binter.
The DA's office says Stott fired 13 rounds from the rifle toward responding officers.
In a letter to Milwaukee Police Chief Jeffrey Norman, Milwaukee County DA Kent Lovern said the officers' use of force was justified, as it came in response to Stott's use of force, "creating the objectively reasonable belief in the minds of the officers that there was imminent risk of bodily harm or death to them."
The investigation was conducted by the Milwaukee Area Investigative Team, led by the Oak Creek Police Department.
