WAUWATOSA, Wis. (CBS 58) -- A father and son have been charged in connection with a shooting that took place at a Wauwatosa apartment complex. 

Damen Hicks Jr., 32, and Damen Hicks Sr., 49, are both charged with one count of conspiracy to commit armed robbery.

The shooting happened Nov. 12, at the Reserve Apartments located on State Street. 

According to a criminal complaint, a tenant at the apartment complex hosts weekly private poker games where approximately 10-20 people are present any given time. 

Officials say it was around 1 a.m. on Nov. 12, when 10-12 people were inside the apartment; a suspect approached the patio door, kicked it and started shooting. 

The complaint says the poker players began yelling "we're being robbed," and scrambled to run away -- some crawling away to find safety. 

Police say two people were shot, and another was injured as they tried to run away. 

A Wauwatosa police officer responding to the shooting came across Damen Hicks Jr. walking nearby the complex. Officials say Hicks Jr. was wearing a mask and gloves he was seen disposing of. 

Hicks Jr. reported he had just been at an apartment to gamble with people he knows, but heard shots being fired and ran away. 

Authorities executed a search warrant at Damen Hicks Jr.'s father's house, identified as Damen Hicks Sr. There, the complaint says officials recovered a handgun that matched the bullet casings left on the patio of the apartment where the shooting took place. 

At first, Hicks Sr. claimed he was "doing Lyft" at the time of the shooting but later admitted he drove Hicks Jr. to the area of the apartment complex and later drove past him interacting with police. 

When investigators interviewed the poker players in the apartment, they stated Hicks Jr. was never invited to the party. 

Authorities say Hicks Sr. acted as the "getaway" for Hicks Jr. by driving him to and from the scene of the shooting and attempted robbery.

Both are due in court next week.
