Milwaukee man charged in shooting that injured teenage boy near 31st and Villard

MILWAUKEE (CBS 58) -- A Milwaukee man has been charged with three felonies in connection with a Friday, July 11 shooting that injured a 17-year-old boy riding a scooter on West Villard, according to a criminal complaint filed in Milwaukee County Circuit Court.

Prosecutors charged 56-year-old Terrance Jeff Toliver with first-degree reckless injury with use of a dangerous weapon, possession of a firearm by a felon and felony bail jumping.

According to the complaint, Milwaukee police responded to 31st and Villard after 911 calls reported gunfire. Officers arrived to find the teenage victim suffering gunshot wounds to his abdomen and left forearm. He was taken to Froedtert Hospital and underwent emergency surgery.

A Lime Scooter was found near the scene, along with a blood trail and a spent bullet recovered from the curb. Witnesses told police they saw a black SUV slow down near the boy, followed by four to five gunshots before the teen collapsed.

Detectives interviewed the boy the next day at the hospital. He said he had been leaving summer school when he encountered a "laid-back style old Dodge" near the intersection. The boy said the driver initially paused, stared at him and followed him before gunfire erupted.

Surveillance footage from a nearby business reportedly showed the Dodge Magnum with its driver’s window open as the boy crossed in front of it. No other people or vehicles appeared near the victim at the time, according to investigators.

A search warrant executed Monday, July 14 led police to recover a spent 9mm casing from the rear floorboard of the SUV, along with documents bearing the defendant’s name. That same day, the victim identified Toliver in a photo lineup as the driver and alleged shooter.

Police arrested Toliver on Friday, July 19 outside his home. A search of the apartment revealed what is believed to be a bullet lodged behind a baseboard. Detectives reportedly recovered a projectile consistent with 9mm or .40 caliber ammunition from inside the wall.

Toliver later reportedly denied involvement in the shooting and did not explain how the vehicle came to be at the scene.

Court records show Toliver has prior felony convictions for firearm possession and escape. At the time of the shooting, he was out on bond in a Racine County case involving alleged felony theft. The terms of that bond prohibited new criminal activity.

A preliminary hearing is set for Thursday, July 31.

Officials say a suspect fired multiple shots from inside a vehicle around 11:25 a.m., striking the teen.

The victim was taken to an area hospital for treatment of non-fatal injuries.
