WEST ALLIS, Wis. (CBS 58) -- Thirteen years after a teen's death in West Allis, two men are being charged.

Court records say on Dec. 14, 2012, 16-year-old Corey Stingley was held by three men in VJ's Food Mart until he lost his pulse.

He died on Dec. 29 from brain swelling from asphyxia.

Court documents say Stingley planned to steal wine coolers but put them on the cashier's counter before taking his card back and trying to run. That's when three men: Robert Beringer, Jessie Cole, and Mario Laumann, caught him and held him on the ground.

Beringer and Cole are charged with felony murder and false imprisonment as a party to a crime.

They are not in custody and are due back in court Thursday, Jan.15.
