Online court records show Officer Michael Mattioli had a preliminary hearing Monday morning, Aug. 31, where a judge bound him over for trial.
Mattioli was off-duty back in April when investigators say he put Joel Acevedo in a choke hold at his home, killing him.
Milwaukee police say Mattioli violated the police code of conduct.
He's also facing a disciplinary trial but remains on paid leave from the department.
