Two Milwaukee officers cleared in Cinco de Mayo shooting
MILWAUKEE (CBS 58) -- Milwaukee police officer Gregory Rupnick and officer Andrew Langer has been cleared for using force on a shooting suspect during a May Cinco de Mayo celebration.
According to the Milwaukee Police Department, police heard multiple gunshots near Cesar Chavez Drive. Officers observed a male, later identified as Hector Silva, stand outside a gray vehicle and fire 3-4 shots. Officers began to approach him and ordered him to drop his weapon, but police say he did not follow commands, running into a nearby residential area while still holding a firearm in his right hand.
Rupnick pursued Silva from behind. According to police, Rupnick feared for his safety and for his fellow officers, who were getting closer to Silva as Silva began to turn toward an officer while still holding his weapon. Rupnick fired one shot with his service rifle, which non-fatally wounded Silva. Officers observed Silva discard his handgun as he fell to the ground and was apprehended. Silva was treated for his injury.
According to the Milwaukee County District Attorney's Office, "the use of force by Officer Rupnick was in response to Silva's use of potentially deadly force in the midst of other individuals, which caused imminent risk of bodily harm or death to those around him."
The office determined Rupnick's use of force justified and is closing its review.
According to the police, Langer observed Deon Nabors raise his gun upward and fire seven shots at the same event. Langer ordered Nabors to stop, and while Nabor's was still in possession of a firearm, shot him numerous times. Langer caused Nabors multiple non-fatal gunshot wounds.
The office determined Langer's use of force justified and is closing its review.
