’He took a life’: Family reacts to charges in crash that killed Officer Her

MILWAUKEE (CBS 58) --- Dante James has been formally charged in the crash that killed Milwaukee Police Officer Kou Her on Tuesday. Dante James, 34, is charged with Homicide By Intoxicated Use of a Vehicle, causing Officer Her's death on June 18.

Officials from the Crash Reconstruction Unit say based on evidence, Dante James was going about 30 miles over the speed limit seconds before the crash occurred. According to the criminal complaint, James' BAC was .209, which is more than twice the legal limit.

"When you're drunk and driving that's like a bullet flying through the streets," Officer Her's brother, Kong said. 

James had been drinking for hours before the crash. He was reportedly terminated from his job on June 17 when he showed up to work drunk and failed a breathalyzer test with a .176 BAC. After that, police say James went to his cousin's house where he took shots, and then went to a bar where he was drinking until he got kicked out. 

Records indicate that James had four OWI convictions prior to the crash that killed Officer Her, and his driving privilege was revoked at the time of the collision.

"It's been boggling my mind, like how is someone like that on the road still," Kong Her said. "I'm sure if the law was a lot harder, I'm sure he would have never been on the streets and my brother would still be alive today."
